ICE Announces Nation-wide Audits June 24, 2011— Immigration and Customs Enforcement (ICE) have sent notices to 1,000 companies across the United States informing them that auditors will be inspecting their hiring records. The agency did not release the names of any of the companies, but indicated that the employers range from small businesses to major enterprises, operating in areas defined as "critical infrastructure and key resources," including cargo handlers, food production, information technology, financial services, heavy construction, drinking water/water treatment systems, transportation systems, and telecommunications. Employer participation in E-Verify does not preclude being audited for compliance. For employers, and if violations are uncovered, the audits can lead to both civil and criminal After receiving a notice of inspection, a company generally has three business days to present the I-9 forms. ICE also requests supporting documentation, which may include a copy of the payroll, list of current employees, articles of incorporation, and business licenses. This recent activity brings the number of companies audited by ICE in the current fiscal year to 2,338.The number of I-9 audits has risen dramatically from 500 in 2008 to 2,196 in 2010.
