Updates From Beijing, Shanghai, and Shenzhen March 4, 2011— As of March 1st, 2011, the Beijing/Shanghai Administration and Industry Bureau has updated its policy regarding Representative Offices: 1. Representative Offices will need to go through an Annual Inspection process every year. This process will need to be submitted to the Beijing/Shanghai Administration and Industry Bureau between March 1 and June 30 of every year. 2. An Appointment Letter is required to apply for the Representative Certificate for foreign employees who are assigned to work in a Representative Office. Attached is a template of the Appointment Letter which needs to be issued from the overseas head office, notarized by foreign notary public bureau and legalized by Chinese embassy overseas. 3. An applicant’s passport copy which needs to be notarized by foreign notary public bureau and legalized by Chinese embassy overseas is also required for the application of Representative Certificates. Also, effective immediately applicants in Shenzhen are now required to present themselves at the Public Security Bureau (PSB) on the following 2 occasions—on the day of application submission and on the day that the passport is picked up. During both occasions the applicant will be accompanied by their immigration consultant. This policy change affects both initial and renewal applications. Applicants must submit all application paperwork to the PSB. The paperwork will be prepared by your immigration consultant in advance. There will be an interview for initial applicants between the PSB officer and the applicant. The PSB will require the applicant’s passport for 6 – 12 working days, whilst the application is in process. The Applicant will receive a receipt after the interview, or submission for renewal cases. The applicant will exchange the Receipt for the Residence License and collection of original passport. |
